The new Teachers’ Standards came into effect on 1 September 2012. These coincided with new, less prescriptive Regulations requiring governing bodies to have a written appraisal policy, to set performance objectives and to have an annual performance appraisal.

 

The Department for Education has also issued an optional model appraisal policy. This includes a model capability procedure with a shorter monitoring and review period and which could be invoked to support the dismissal of under-performing teachers over the period of only a school term.

 

Although teachers in academies, free schools and other independent schools are not covered by the new Regulations, they can choose to adopt the new Teachers’ Standards.

 

All educational establishments, irrespective of their status, are subject to the ACAS Code of Practice on Disciplinary and Grievance Procedures. Failure to comply with the ACAS Code can lead to successful Employment Tribunal claims and increased compensation.

 

This seminar, presented by James Wilders, partner and Laura Daniels, associate in Dickinson Dees’ employment team, will...
1.      Look at the new Regulations and the timetable for objectives setting, appraisals and reports;
2.      Analyse the new D for E model appraisal policy and accompanying model capability procedure;
3.      Explain the Law in relation to the management of poorly performing teachers, including an explanation of the    ACAS Code;

4.      Give details of the remedies available to a teacher in an Employment Tribunal;

5.      Provide practical do’s and don’ts for when dealing with under-performing teachers.
The seminar will be relevant to academies and maintained schools alike, with a strong focus on the routes available to improving performance and the pitfalls for the unwary.
