Dealing with Absence, Stress and Disability

This seminar for schools will consider the issues around dealing with staff with stress related and/or long term ill health conditions. We will also consider how to address performance and absence management issues as well as the importance of understanding what may amount to a disability under the terms of the Equality Act.  Through the use of practical scenarios and examples we will explore:

  • the background employment law requirements for managing performance and absence issues;
  • the components of disability under the Equality Act:

What type of impairment is considered?
When does an impairment have a “substantial long term adverse effect?”
What are “normal day to day activities?”

  • the potential basis for disability discrimination claims and how to address them;
  • understanding the employer’s duty to make reasonable adjustments and its interaction with the management of absence;
  • the risks of any claims and how to manage them.
